Terms and Conditions for Holidays and Creative Retreats

These Terms and Conditions govern all bookings for packages, holidays, and creative retreats organized by Make Love Not Landfill.

1. Booking, Financial Protection, and Trust Accounts

• Independent Trust Account: In compliance with the European Package Travel Regulations, all client funds paid for accommodation and inclusive activities are held securely in an independent trust account. These funds remain untouched and inaccessible to us until your holiday is completed, ensuring effortless refunds if required.
• Insolvency Protection: We maintain comprehensive insurance covering business financial failure, securing full repatriation or refunds if necessary.
• Regulatory Compliance: Because we do not offer flights, our packages are not ATOL protected. Full protection is instead delivered via the European Package Travel Regulations.

2. Cancellations and Transfer Fees

If a traveler wishes to cancel or transfer their package to another party, the following tier-based administrative structure applies. All refunds are processed within 24 days of written cancellation.

• Early Grace Period: If your booked retreat is more than 6 months away at the time of purchase, you are entitled to cancel fee-free within 14 days of booking. To request a full cancellation under this grace period, you must contact us directly at hello@makelovenotlandfill.co.uk. After this 14-day window expires, standard terms and conditions apply.
• Long-Term Notice (90+ Days):
  
  • Transfers: Subject to a £66 administration fee.
  • Cancellations: Loss of the initial £111 “secure my spot” reservation payment to cover marketing and reselling costs.

• Mid-Term Notice (45+ Days):
  
  • Transfers: Subject to a £66 administration fee, plus any variable costs if custom items have already been produced.
  • Cancellations: A termination fee of 50% of the total package cost applies, plus any non-recoverable custom production fees.

• Short-Term Notice (Less than 45 Days):
  
  • Transfers: Subject to a £116 administration fee, plus any variable costs required to alter custom attendee items.
  • Cancellations: A termination fee of 100% of the package cost applies.

Note: If a canceled space is successfully resold to another guest, the traveler will be refunded in accordance with the standard Long-Term policy.

3. Force Majeure & Unusual Visual Circumstances

We cannot accept liability or pay compensation where the performance of our contractual obligations is prevented or affected by “Force Majeure” (unavoidable and extraordinary circumstances beyond our control). This includes, but is not limited to:

• War, threat of war, or civil strife.
• Acts of terrorism or industrial disputes.
• Acts of God, natural disasters, severe weather conditions, or volcanic eruptions.
• Sudden medical travel restrictions, pandemics, border closures, or government-imposed travel rules.
• Nuclear disasters or unforeseen technical transport failures.

4. Essential Variations and Exceptional Circumstances

• Significant Material Changes: If an essential component of your package must be changed significantly before departure, you have the right to terminate the contract with a fee-free refund.
• Exceptional Security Circumstances: Travelers can cancel their contract without penalty before the start date if exceptional, unavoidable security problems arise at the destination that directly affect the package safety.

5. Cancellation by the Organiser

We reserve the right to cancel a retreat up to 14 days before departure (for trips lasting 2–6 days) under the following conditions:

• The required minimum participant numbers are not met.
• Unavoidable and extraordinary logistical circumstances prevent performance of the contract.
• A traveler breaches booking rules, acts unkindly or aggressively toward staff or guests, or endangers the safety and inclusion of the group. In active trip scenarios, safety violators will be removed immediately without a refund.
